TERMS AND CONDITIONS
These Terms and Conditions constitute a legally binding agreement between Precious Safaris (hereafter referred to as “the Company,” “we,” “us,” or “our”) and the client (hereafter referred to as “the Client,” “you,” or “your”) who books a tour or safari with us. By booking a tour with us, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
1. Booking and Confirmation
1.1. Tour Booking: All tour bookings must be made in writing via email or through our official booking form. A booking is considered confirmed only upon receipt of a completed booking form and the required deposit as outlined in Section 2.
1.2. Client Information: You are responsible for providing accurate and complete personal information, including full names as they appear on passports, passport numbers, nationalities, and any special requirements (e.g., dietary restrictions, medical conditions). We are not liable for any issues arising from incorrect or incomplete information provided by you.
2. Payments
2.1. Deposit: A non-refundable deposit of 40% is required at the time of booking to secure your reservation.
2.2. Final Payment: The remaining balance is due no later than 30 days before the tour start date. If the booking is made within 30 days of the tour start date, the full payment is required at the time of booking.
2.3. Failure to Pay: If the final payment is not received by the due date, the Company reserves the right to treat the booking as canceled and apply the cancellation fees outlined in Section 3.
2.4. Accepted Payment Methods: We accept the following secure payment methods:
- Bank Wire Transfer: Payments can be made via a direct bank wire transfer. Our bank account details will be provided to you on your invoice or upon request after your booking is confirmed. Please note that all bank transfer fees are the responsibility of the Client.
- Online Payment (Pesapal): We use a secure online payment platform, Pesapal, to facilitate convenient and safe credit card transactions. You will receive a secure payment link via email after your booking is confirmed. Please note that a service fee of 3.5% will apply to all Pesapal transactions to cover the platform’s processing costs. This fee will be added to your final invoice.
3. Cancellations and Refunds
3.1. Cancellation by the Client: All cancellations must be made in writing. Cancellation fees are calculated based on the date the written cancellation is received by Precious Safaris:.
- 10% cancellation fee if canceled more than 90 days before the tour starts;
- 25% cancellation fee if canceled 60-89 days before the tour starts;
- 50% cancellation fee if canceled 30-59 days before the tour starts;
- 70% cancellation fee if canceled 8-29 days before the tour starts;
- Regrettably, no refund can be provided for cancellations made 0-7 days prior to the tour start date.
3.2. Cancellation by the Company: In the rare event that Precious Safaris must cancel a tour due to unforeseen circumstances beyond our control (e.g., natural disaster, political unrest, force majeure), we will offer a full refund of all payments received. This refund will be the full extent of our liability. We are not responsible for any additional costs incurred by the Client, such as international airfare or visa fees.
3.3. No-Shows: If you fail to show up for your tour on the scheduled start date, your payment will be forfeited in full, and no refund will be issued.
4. Changes and Itinerary
4.1. Changes by the Client: Any request to change a confirmed booking must be made in writing. We will make our best effort to accommodate your request but cannot guarantee it. Additional costs incurred due to changes will be the responsibility of the Client. An amendment fee may apply per change.
4.2. Changes by the Company: The Company reserves the right to make minor changes to the itinerary, including accommodations, routes, or activities, if necessary due to local conditions, weather, or circumstances beyond our control. We will always strive to provide an equivalent or superior alternative.
5. Client Responsibility
5.1. Passports and Visas: You are solely responsible for ensuring you have a valid passport with sufficient blank pages and all necessary visas, permits, and vaccination certificates for your travel. Your passport should be valid for at least six months beyond your return date.
5.2. Health and Fitness: You must be in good health and physical condition to undertake the tour. It is your responsibility to consult with a medical professional regarding any health concerns or special requirements before booking.
5.3. Conduct: We reserve the right to decline, accept, or retain any person as a tour participant at any time. If a participant’s conduct is deemed disruptive, offensive, or dangerous to other guests or themselves, we may remove them from the tour without a refund.
6. Liability
6.1. Limitation of Liability: Precious Safaris and its agents act only as agents for the service providers (e.g., hotels, transportation companies, guides) used during the tour. We are not liable for any injury, damage, loss, accident, delay, or irregularity which may be occasioned by reason of any defect in any vehicle, or through the acts or defaults of any company or person engaged in carrying out the tour arrangements.
6.2. Force Majeure: We are not liable for any failure to perform our obligations if such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, war, riot, terrorism, strikes, natural disasters, or pandemics.
7. Insurance
7.1. Travel Insurance: It is a mandatory condition of booking a tour with Precious Safaris that you have comprehensive travel insurance. This insurance must cover personal accidents, medical expenses, emergency evacuation, repatriation, and luggage loss. We recommend a policy that also covers trip cancellation and interruption. We are not responsible for any costs incurred due to a lack of or insufficient insurance coverage.
8. Miscellaneous
8.1. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Republic of Tanzania
8.2. Photography: Precious Safaris reserves the right to take photographs and videos during the tour for promotional purposes. By booking with us, you consent to the use of your image in such materials unless you explicitly notify us in writing before the tour.
8.3. Acknowledgment: By making a booking with Precious Safaris, you acknowledge that you have read, understood, and agreed to all of the above terms and conditions.
